Protecting the security and privacy of your personal data is important to Flender. Therefore, Flender GmbH, Germany, and its group companies (hereinafter referred as to “Flender”) processes personal data in connection with the use of this Flender Career-Site (hereinafter “Web Site”) in compliance with applicable laws on data protection and data security.
The application of under-age persons for an education at Flender may be subject to individual data protection regulations, to which the applicant concerned is then informed separately.
1. Responsible data controller
Flender GmbH, Germany, and/or its group companies are responsible for the processing activities described in this Privacy Policy.
2. Purpose of the processing, categories of personal data processed
Flender processes your personal data for the following purposes- To provide the use of the Web Sites services and functions
- To verify your identity and to enable authentication
- To communicate with you (e.g. to answer your request)
- For potential analysis and applicant selection
- To check and carry out the application process (such as applicant interviews and selection of suitable persons)
- For the planning, implementation and management of pre-contractual measures
- For the planning and implementation of contractual measures
- To prevent fraud or other illegal activities, including attacks on Flender’ products, services and information technology systems
- For ensuring compliance with (i) legal obligations (such as record keeping obligations relating to tax- or commercial law)), (ii) compliance screenings and (iii) Flender policies
- To solve disputes, enforce our contractual agreements and to establish, exercise or defend legal claims.
- Personal data that you actively and voluntary provide Flender in connection with an online job application such as:
- Contact information (e.g. address, phone number, e-mail address)
- Date and place of birth
- Application details, qualifications (e.g. professional career, education, curriculum vitae)
- Whether an employment relationship with a Flender company existed in the past
- Personal skills, languages etc.
- Personal data that Flender requests from you for the planning and implementation of pre-contractual measures (e.g. copy of identity card, social security number, etc.)
- Personal data collected from publicly available resources, integrity data bases and, if applicable, credit agencies
- Information that is automatically sent to us by your web browser or device, such as your IP-address, device type, browser type, referring site, sites accessed during your visit, the date and time of each visitor request, if applicable, also your location.
3. Transfer and disclosure of personal data
Flender may transfer your personal data toother Flender companies, if this is necessary in connection with your online job application or for the purpose of internal communication and cooperation;
third parties which provide IT services to Flender and which process such data only for the purpose of such services (e.g. hosting or IT maintenance, for the provision of job portals); and
courts, arbitration bodies, law enforcement authorities, regulators or attorneys if necessary, to comply with the law or for the establishment, exercise or defense of rights or legal claims.
The recruiting process for some job offerings may require your voluntary participation in evaluation, selection or similar processes conducted by third parties. In such case Flender GmbH or the Flender group company offering the relevant job position will inform you about the respective process(es) and recipient(s) in the course of the recruiting process and before transferring application data to such recipient.
Flender uses external IT service providers for the provision of job portals and the related collection of personal data. These service providers collect and process personal data on behalf of Flender. A corresponding commissioned data processing contract was concluded in accordance with Article 28 of the General Data Protection Regulation (GDPR).
4. Retention periods
Unless indicated otherwise at the time of the collection of your personal data (e.g. within a form completed by you), we erase your personal data if the retention of that personal data is no longer necessary (i) for the purposes for which they were collected or otherwise processed, or (ii) to comply with legal obligations (such as retention obligations under tax or commercial laws).
5. Links to other websites and applications
This Privacy Notice applies only to this Web Site and not to other websites or applications operated by third parties. We may provide links to other websites and applications which we believe may be of interest to you (e.g. Google Maps, YouTube, LinkedIn). Flender is not responsible for the privacy practices of such other websites or applications.
If you click on a link to a digital offer of a third party, you will be directed to the website or application of this third party and thus leave our Web Site.
Flender is not responsible for the collection, processing and use of your data within the framework of these websites and applications of third parties not operated by Flender. The individual data protection provisions of the respective operators of the websites and applications apply.

You may have certain rights with respect to your personal data under the applicable data protection laws in the country where you live. You will find more details about your rights in the following sections or you can contact the Flender Data Privacy Organization. 7. Processing under the EU’s General Data Protection Regulation: your rights, legal basis for the processing and international transfers
This section applies and provides you with further information if you are located in the European Economic Area.
Your rights under the General Data Protection Regulation
You have the right to
- request access to the personal data we process about you;
- obtain from Flender the rectification of your personal data (e.g. if they are incorrect, inaccurate or incomplete);
- obtain from Flender the erasure of your personal data;
- obtain from Flender restriction of processing regarding your personal data, e.g. in case you contest the accuracy of the personal data;
- request portability of your personal data in the form of a copy (in a structured, commonly used and machine-readable format) of personal data that you have provided to Flender with your consent;
- object to the further processing of your personal data insofar as your objection does not prevent the fulfilment of (pre-)contractual obligations.

Legal basis of the proceeding
The General Data Protection Regulation requires Flender to provide you with information on the legal basis of the processing of your personal data:
- Implementation of application processes, pre-contractual measures and the employment relationship (Article 6 (1) (b) of the basic data protection regulation)
(planning or fulfilment of a contract") - Compliance with Flender’s legal obligations (Article 6 (1) (c) General Data Protection Regulation)
(“Compliance with Legal Obligations”), - Legitimate interests pursued by Flender (Article 6 (1) (f) General Data Protection Regulation)
(“Flender Legitimate Interest”).
Generally the legitimate interest pursued by Flender lies in the processing of your personal data for the purpose of the effective execution of our business activities and for the examination and implementation of the application process as well as any pre-contractual measures. Flender is of the opinion that its legitimate interests is not overridden by your interests and rights or freedoms, given (i) the regular reviews and related documentation of the processing activities described herein, (ii) the protection of your personal data by our data privacy processes, (iii) the transparency we provide on the processing activity, and (iv) the rights you have in relation to the processing activity. - In some cases, we may ask if you consent to the relevant use of your personal data. In such cases, the legal basis for Flender processing that data about you may (in addition or instead) be that you have consented (Article 6 (1) (a) General Data Protection Regulation).
Your once given consent to the processing of personal data can be revoked at any time. Please note, however, that the job application procedure cannot be carried out in this case.
8. International data transfer
Sometimes the recipients to whom Flender transfers your personal data are located in countries in which applicable laws do not offer the same level of data protection as the laws of your home country. In such cases, if required by applicable law, Flender takes measures to implement appropriate and suitable safeguards for the protection of your personal data.
We transfer personal data to external recipients in such countries only if the recipient has entered into EU Standard Contractual Clauses with Flender and where applicable provides additional appropriate safeguards according to Art. 46 GDPR.
We share your personal data with Flender companies in such countries only if it is necessary in connection with the business transaction or with your application and if they have agreed to the Flender Intercompany Agreement on the processing of personal date, which includes the EU Standard Contractual Clauses as amended from time to time, and have implemented the internal guidelines on the protection of personal Data. The Intercompany Agreement and internal guidelines contain rules that define Flender’ s global data privacy strategy with regard to international transfers of personal data between Flender group companies.
